As the government recently passed the National Defense Authorization Act there’s much fuss over Sec 1031 and 1032, I have even posted this on the thetruthnews.info a couple weeks ago from the ACLU and finally have gone through it myself to see what exactly is in it, and I just don’t see it.
I see non-American citizens all through it and as far as Sec 1031 and 1032 here they are below, please let me know what I am missing.
Subtitle D—Detainee Matters
Sec. 1031. Affirmation of authority of the Armed Forces of the United States to detain covered persons pursuant to the Authorization for Use of Military Force.
This is section 1031.
“DEFINITION OF INDIVIDUAL DETAINED AT GUANTANAMO.
`Individual detained at Guantanamo’ means any individual who is located at United States Naval Station, Guantanamo Bay, Cuba, on or after March 7, 2011, who–
(1) is not a citizen of the United States or a member of the Armed Forces of the United States; and
(2) is in the custody or under the effective control of the Department of Defense.”
This is section 1032:
“SEC. 1032. EXTENSION OF AUTHORITY TO MAKE REWARDS FOR COMBATING TERRORISM.
Section 127b of title 1 0, United States Code, is amended–
(1) in subsection (c)(3)(C), by striking `September 30, 2011′ and inserting `September 30, 2014′; and
(2) in subsection (f)(1), by striking `December’ and inserting `February’.”
So 1032 just changes the Expiration Date, and 1031 is definition of someone who can be sent to Guantanamo as a non-American Citizen and a threat.
Subtitle D—Detainee Matters SEC. 1031. AFFIRMATION OF AUTHORITY OF THE ARMED FORCES OF THE UNITED STATES TO DETAIN COVERED PERSONS PURSUANT TO THE AUTHORIZATION FOR USE OF MILITARY FORCE.
(a) IN GENERAL.—Congress affirms that the authority of the President to use all necessary and appropriate force pursuant to the Authorization for Use of Military Force (Public Law 107–40) includes the authority for the Armed Forces of the United States to detain covered persons (as defined in subsection (b)) pending disposition under the law of war.
(b) COVERED PERSONS.—A covered person under this section is any person as follows:
(1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those a ttacks.
(2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.
