THEY CROSSED THE RED LINE. When pastors in Idaho face jail time for refusing to “marry” homosexual couples, and the government demands Houston pastors turn over their sermons and private communications dealing with homosexuality, the red line of liberty has been crossed. There is no longer any doubt, the homosexual agenda brings with it an unprecedented assault on religious liberty and freedom of conscience against pastors, churches, business and facility owners, employees, public officials, organizations, ministries, and citizens.

Why does this matter? Because the right to vote matters. Because Freedom matters. And because Marriage matters. To Give up on marriage is to give up on freedom and also to give up on America. Giving up is not an option.

Why Restrain Judges?

1.  Judges are the primary problem.
2.  It can be done by a majority vote.
3.  It’s been done before many times (for less important issues)
4.  We must advance marriage, freedom, and the right of our citizens to vote, rather than just wring our      hands and denounce the assault.
5. Greater is He that is in us than he that is in the world.

We must restrain the judges now–before a single pastor goes to jail.

If federal judges won’t honor state marriage amendments, then we must reign in their jurisdiction through our elected representatives in Congress.

“The Supreme Court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.”

This means that Congress can “make exceptions” to the kinds of cases Federal Courts can hear. On July 22, 2004 the U.S. House, by a vote of 233-194, approved Rep. John Hostettler’s (R-Ind.) H.R. 3313, “Marriage Protection Act” that removes from federal courts the jurisdiction to tamper with the Defense of Marriage Act (DOMA). If it had passed in the Senate, we wouldn’t be in this mess.

Judicial restriction has also become law with a bill introduced by Senator Tom Daschle in 2002 to prohibit all federal courts from hearing cases about brush-clearing in his home state of South Dakota.

The long list of Federal statutes in which Congress successfully restricted the jurisdiction of the Federal courts includes the Norris-LaGuardia Act of 1932, the Emergency Price Control Act of 1942, the Portal-to-Portal Pay Act of 1947, the 1965 Medicare Act, the Voting Rights Act of 1965, and the 1996 immigration amendments. Isn’t the protection of marriage just as important as any of those issues on which Congress effectively withdrew jurisdiction from the Federal courts?

Is not marriage more important than brush fires in South Dakota? When judges strike down the vote of the people to protect marriage, it ignites a brush fire against our liberty–which has now reached the doors
of the church–and must be immediately extinguished.

Playing off our Pink Slip idea–where we sent more than 10 million Pink Slips to Congress–we can multiply our effectiveness and show of support by letting people send hundreds of “Restraining Orders” at once.
